NOTICE OF 2ND HEARING
ON PROJECT STATUS

 
SMUD COSUMNES POWER PLANT PROJECT
APPLICATION FOR CERTIFICATION
DOCKET NO. 01-AFC-19


Purposes of
Hearing:
The purposes of the Project Status Hearing are to review:
1.   the status of the proceeding,
2.   the timeliness and completeness of Applicant data submissions, and
3.   the schedule for the remainder of the Application for Certification (AFC) proceeding.

 

 
 
Discussion:

Following a May 14, 2002, Hearing on Project Status, and an Energy Commission Staff workshop, the Committee received a jointly proposed schedule from Staff and Applicant. On June 5, 2002, the Committee promulgated the "Committee Schedule" which enumerated a number of critical path items necessary for the preparation and public release of the Preliminary Staff Assessment and the Final Staff Assessment. On August 8, 2002, the Staff issued its Preliminary Staff Assessment (PSA) with certain topics not addressed.

Both the Staff and SMUD have filed monthly Status Reports since the publication of the Committee Schedule. Staff has reported that as of December 2002 one critical path item, a Biological Assessment accepted by USFWS and NMFS, has not been accomplished by SMUD; and therefore, the Final Staff Assessment cannot be completed. In the schedule jointly proposed by SMUD, it asserted that the Biological Assessment would be accepted by USFWS and NMFS in July or August 2002. The acceptance of SMUD's Biological Assessment leading, if adequate, to the completion of a federal Biological Opinion and the issuance of a federal permit are prerequisites for SMUD to begin construction of its project.

To assist the Committee in this matter, Staff, Applicant, and the other parties shall be prepared to present scheduling suggestions and discuss scheduling options at the hearing noticed below.
