The California Energy Commission adopted the Commission Decision on the SMUD Cosumnes Project on September 9, 2003. The Commission approved Phase 1 (500 MW) of SMUD's proposed 1,000 megawatt power plant adjacent to the Rancho Seco Nuclear Power Plant in southeast Sacramento County, with conditions to mitigate potential environmental and community impacts.

On October 8, 2003, Intervenor, Kathy Peasha, filed a "Request for Reconsideration."
