COMMISSION ORDER TERMINATING PROCEEDING


I. BACKGROUND

On October 23, 2007, Applicant filed a notice withdrawing the Application for Certification in the above-captioned proceeding. On October 25, 2007, the assigned Committee issued an "Order Terminating Proceeding" in this case.

II. DISCUSSION

ApplicantŐs notice of withdrawal complies with Section 1709.8 of the Energy Commission's regulations. Section 1709.8(b) provides that the presiding member shall issue a written order terminating proceedings upon receipt of a properly executed withdrawal notice

III. ORDER

The Application for Certification proceeding for the South Bay Replacement Project is hereby terminated. The docket in this case (No. 06-AFC-3) shall be closed.

We therefore affirm and adopt the Committee ORDER.
