REVISED PRESIDING MEMBER'S PROPOSED DECISION
AND NOTICE OF ENERGY COMMISSION HEARING
I. NOTICE OF AVAILABILITY
On May 13, 2004, the Committee issued the Revised Presiding Member's Proposed Decision (PMPD) for the Tesla Power Project. The document may be viewed on the Energy Commission's Internet Web page at: www.energy.ca.gov/sitingcases/tesla. For a printed copy, call the Energy Commission's Publications Unit at 916-654-5200, and ask for Publication No. P800-04-011.
Members of the public and governmental agencies may submit written comments on the Revised PMPD. Twelve copies of all comments must be received no later than 5 p.m., Monday, June 14, 2004, by the Energy Commission's Docket Unit, MS-4, 1516 Ninth Street, Sacramento, CA 95814, or in the alternative, comments may be sent by e-mail in MS Word format to: firstname.lastname@example.org. Identify all comments with "Docket No. 01-AFC-21." Please contact the Energy Commission's Public Adviser as indicated below for information on how to participate.

PLEASE TAKE NOTICE that the Energy Commission will conduct a public hearing to consider whether to adopt the Revised PMPD at its regularly scheduled business meeting scheduled on:

Applicant, Staff, and Intervenors intending to participate at the Energy Commission hearing shall file and serve written comments on the Revised PMPD no later than 5 p.m., Monday, June 7, 2004. Comments shall also be sent via e-mail in MS Word format to the parties and to the Hearing Officer.
The Verifications of Conditions proposed by Staff for the topics of Biological Resources and Cultural Resources require due dates that are internally inconsistent with other Verifications of Conditions for those topics. Specifically, due dates for documents needed to complete the Biological Resources Mitigation Implementation and Monitoring Plan (BRMIMP) would occur after the final BRMIMP is due. Due dates for compliance with Conditions established for Cultural Resources are not rational since due dates vary from 5 to 10 to 30 to 45 to 90 days without regard to the action required.
The parties shall provide revised due dates for compliance with the Conditions for Biological and Cultural Resources to provide a rational approach for the compliance effort. In addition, the due dates contained in Verifications of Conditions for all other topics shall be reviewed and revised, if necessary, in accordance with these concerns.
