[California Energy Commission Letterhead]

On February 6, 2003, the California Energy Commission (Energy Commission) received a petition to amend the Energy Commission Decision for the Tracy Peaker Project. The Tracy Peaker Project is a nominal 169 MW natural gas-fired power plant currently under construction. The facility is located in an unincorporated portion of San Joaquin County, southwest of the City of Tracy.

DESCRIPTION OF PROPOSED CHANGE: 1) Clarify and simplify the methodology for tracking and reporting emissions during startups and shutdowns, 2) eliminate the restriction on the number of startups and shutdowns, 3) provide a mechanism for reducing hourly, daily and annual PM 10 emissions based on anticipated lower PM10 source tests results, and 4) provide a mechanism for reducing PM10 emission offset requirements in the event that PM10 emission limits are lowered.

The purpose of the Energy Commission's review process is to assess the impacts of this proposal on environmental quality, public health and safety. The review process includes an evaluation of the consistency of the proposed changes with the Energy Commission's Decision and if the project, as changed, will remain in compliance with applicable laws, ordinances, regulations, and standards (Title 20, Calif. Code of Regulations, section 1769). Energy Commission staff is currently analyzing the request and will publish an analysis in the next several weeks. A public hearing for the purpose of approving or denying the amendment proposal will subsequently be held at a regularly scheduled Energy Commission business meeting.

This Notice of Receipt is being mailed to interested parties and property owners adjacent to the project site who may want to participate in the amendment process.
