NOTICE OF REVISED SCHEDULE
This NOTICE provides information regarding revised scheduling. The new schedule is attached to the end of this Notice.
Status Update
On March 6, 7, 8, 13, 14 and 28, 2002, the Committee conducted formal evidentiary hearings on GWF Energy LLC's Application for Certification of the Tracy Peaker Project. Upon conclusion of the hearings the parties were granted the opportunity to file post-hearing briefs, and the Committee specifically requested that the parties brief the following legal issues:
- In order to find LORS compliance and that the TPP was a permitted use, did the CEC, as the lead agency, have to make all of the findings (and subfindings) the County of San Joaquin would have made had it been the lead agency on the project?
- What is the relevance of the City of Tracy's LORS to the CEC siting process?
Post-hearing briefs must be filed no later than 4:00 p.m. on April 11, 2002. An individual party's brief cannot exceed 15 pages. Jointly filed briefs cannot exceed 10 pages per party (e.g., a joint brief by two intervenors may not exceed 20 pages, a joint brief by three intervenors may not exceed 30 pages, etc.)
It is the Committee's intention to issue the Presiding Member's Proposed Decision (PMPD) by the end of May 2002. Issuance of the PMPD will be followed by a 30 day public comment period, and ultimately a decision on the PMPD by the full Commission.
