The Valero AFC Committee released its Presiding Member's Proposed Decision (PMPD) on Valero's Cogeneration Project on August 30, 2001. The Proposed Decision recommends granting the Application for Certification with conditions that mitigate potential environmental and community impacts.

Printed copies of the PMPD are available from the Commission's Publications Unit, 1516 9th Street, MS-13, Sacramento, CA 95814. You may telephone the Publications Unit at (916) 654-5200 and ask for Publication No. P800-01-021. The PMPD may also be viewed on the Commission Internet Web Site at: www.energy.ca.gov/sitingcases/valero


Members of the public and interested governmental agencies may submit written comments on the Proposed Decision. The public comment period ends October 1, 2001. All comments (an original and 11 copies) must be received no later than close of business by the Commission's Docket Unit, 1516 9th Street, MS-9, Sacramento, CA 95814. Identify Docket No. 01-AFC-5.

Applicant, staff, and all other formal parties wishing to participate at this conference are requested to file and serve written comments on the PMPD, excluding Air Quality, by September 21, 2001.

Members of the general public attending this conference are not required to submit their comments in writing. The deadline for public comments by mail or e-mail is October 1, 2001.

Continued Evidentiary
Hearing - Air Quality:

The purpose of the evidentiary hearing is to establish the record on Air Quality issues through the taking of oral, written or documentary evidence under oath from the Bay Area Air Quality Management District (BAAQMD), Applicant, Commission staff, and others. The taking of testimony will be preceded by discussion of Air Quality issues and their potential resolution.

Any witness must appear in person to testify under oath and may be subject to cross-examination by other parties. A party sponsoring an expert witness, either by declaration or in person, shall establish the witness' qualifications.

Direct testimony, other than the BAAQMD's Final Determination of Compliance, must be filed and served not later than September 24, 2001.

of PMPD Comments &
Evidence:

To assist the Committee in the preparation of the Final Decision, each party submitting comments on the Presiding Member's Proposed Decision on or before September 21, 2001, shall submit them electronically and, in particular for requested textual changes, in red-line, strike-out Word 97-compatable format. Similarly, any evidence shall be submitted in electronic form not later than September 24, 2001.
