COMMITTEE SCHEDULING ORDER On November 20, 2002, the Energy Commission found the Application for Certification (AFC) eligible for the six month expedited review process established by Public Resources Code section 25550. The Commission designated a Committee of two Commissioners who held a public informational hearing on December 16, 2002, to discuss the schedule and other issues of concern
At the Informational Hearing, Commission staff proposed a schedule that anticipates six months to complete the review process. Applicant agreed with staffs proposed schedule. The following Scheduling Order is based on Staff's proposed schedule and related discussion at the hearing.
The Committee Schedule contains an initial list of events that must occur in order to complete certification review in six months. The initial schedule covers the period up to the Prehearing Conference. The balance of the schedule will be determined at the Prehearing Conference.
Several deadlines listed in the schedule are contingent upon reviews and analyses to be conducted by other federal, state, and local agencies. If those reviews are not completed on the dates listed in the Committee Schedule, the Committee may need to modify the schedule.
The Commission staff is responsible for meeting all Committee deadlines for the filings. The Applicant bears the burden of proof in this proceeding and must be responsible for the timeliness of its own filings as well as those of all other agencies outside the Commission. A delay by an agency other than the Commission staff in filing a required document may result in a necessary extension of the Committee schedule. This is particularly true with the expedited review process.
The Committee may modify the Schedule at any time either upon its own motion or that of a party. [Cal. Code of Regs., tit. 20, sec. 1709(c)].
The attached schedule requires periodic status reports from the parties to determine whether case development is progressing satisfactorily and to bring potential schedule delays or other relevant matters to the Committee's attention.
