On July 9, the Chief Counsel's Office received a complaint regarding a violation of the Energy Commission's HERS Regulations, which are contained in Article 8 of Title 20 (Section 1670, et seq.). The complaint alleges that a HERS rater, Energy Sense, is operating in violation of the conflict-of-interest restrictions in the HERS regulations.
The compliant was filed pursuant to Article 4 of Title 20 (Section 1230, et seq.), which contains the Commission's Complaints and Investigations regulations. Section 1232 of Title 20 mandates that, within 30 days of receiving a complaint, the chairman or assigned committee shall either reject the complaint as insufficient or without merit, or serve the complaint on the respondent (in this case, Energy Sense).
On August 5, 2008 the Efficiency Committee served the complaint to the respondent.
