Two concurrent proceedings to update the field verification and diagnostic testing (FV&DT) program. The first is to relocate program requirements to the Building Energy Efficiency Standards (Energy Code) to improve oversight and performance. The second is to sunset the relocated requirements in the Home Energy Rating System (HERS) program.

The FV&DT is aimed at newly constructed homes or alterations to existing homes to verify compliance with the requirements of the Building Energy Efficiency Standards Title 24, Part 6 (Energy Code). The California Energy Commission (CEC) started this order instituting rulemaking proceeding so all stakeholders and other interested persons may participate in the consideration of the following:

  1. Relocate the FV&DT program data collection requirements from HERS program (23-HERS-01) to the Energy Code (22-BSTD-03)
  2. Improve CEC oversight and program performance by adding or amending provisions for progressive discipline, quality assurance procedures, conflict of interest, rater designation, approval processes, training requirements; and amendments which clarify other sections, as necessary

The CEC uses a public process and a rulemaking to adopt changes to the HERS Program (Title 20, California Code of Regulations, sections 1670-1675) and the Energy Code contained in the California Code of Regulations (CCR), Title 24, Part 6, and associated administrative regulations in Part 1 (collectively considered the Energy Code).

The updated HERS Program regulations will be proposed for adoption in 2023 with an effective date of January 1, 2026, and the Energy Code standards will be proposed for adoption in 2024 with an effective date of January 1, 2026. See the public participation section below for more information.

The CEC encourages public participation in its proceedings.

To participate, interested persons can attend the workshops and provide verbal comments to the record. Written comments can be submitted to the rulemaking docket. Instructions for submitting comments can be found on workshop notices. The Public Advisor's Office can help anyone with questions about the proceedings.
