Align Incorporated (Align) is a City of Industry, California based company that manufactures portable air conditioners, room air conditioners, and battery chargers. Align sold or offered for sale portable air conditioners, room air conditioners, and battery-operated kid’s ride-on toys in California, from May 2018 to October 2022.

This case was the result of an investigation performed by California Energy Commission (CEC) staff. CEC’s investigation and testing process identified that Align was manufacturing and offering for sale portable air conditioners, room air conditioners, and battery-operated kid’s ride-on toys that did not meet the efficiency standard and were not certified to the Modernized Appliance Efficiency Database System (MAEDbS).

To settle this matter, Align executed a Settlement Agreement with CEC on June 28, 2023, for $297,000.00. The penalty monies are deposited into the Appliance Efficiency Enforcement Subaccount established by SB 454 of 2011 (Pavley). Align has also agreed to a compliance plan to discontinue sales of non-compliant models and test and certify all models to MAEDbS before continuing to sell in California.
