Best Choice Products (BCP) is a Tustin, California, based company that manufactures refrigeration products, non-central air conditioner and heat pump products, and electronics. BCP sold or offered for sale non-compliant automatic commercial ice makers and various products containing federally regulated battery chargers in California, from July 2015 to May 2021. Additionally, BCP sold or offered for sale non-compliant portable air conditioners in California from February 2020 to May 2021.

This case was the result of an anonymous complaint. The California Energy Commission's (CEC) investigation process identified that BCP was manufacturing and offering for sale automatic commercial ice makers, portable air conditioners, and various products containing federally regulated battery chargers that were not certified to the Modernized Appliance Efficiency Database System (MAEDbS).

To settle this matter, BCP executed a Settlement Agreement with CEC on November 30, 2021, for $286,574.00. The penalty monies are deposited into the Appliance Efficiency Enforcement Subaccount established by SB 454 of 2011 (Pavley). BCP has also agreed to a compliance plan to test and certify all models to MAEDbS before continuing to sell in California.
