Ferguson Enterprises LLC (Ferguson) is a Newport News, Virginia based company that distributes plumbing and building supplies. Ferguson sold or offered for sale Build Essentials, Miseno brand lavatory faucets and Sylvania and Satco brand incandescent lamps in California, from July 2015 to January 2023

This case was the result of an investigation performed by California Energy Commission (CEC) staff. CEC’s investigation and testing process identified that Ferguson was manufacturing and offering for sale a lavatory faucet that was not certified to the Modernized Appliance Efficiency Database System (MAEDbS) and incandescent lamps that did not meet the efficiency standard.

To settle this matter, Ferguson executed a Settlement Agreement with CEC on August 30, 2023, for $10,000.00. The penalty monies are deposited into the Appliance Efficiency Enforcement Subaccount established by SB 454 of 2011 (Pavley). Ferguson has also agreed to a compliance plan to test and certify all models to MAEDbS before continuing to sell in California.
