Generac Power Systems, Inc. (Generac) is a Waukesha, WI based company who manufactures and distributes generators containing small battery charging systems (SBCS). From February 2013 to July 2017, Generac sold or offered for sale various generators in California.
This case was a result of a market survey performed by California Energy Commission (Energy Commission) staff. The Energy Commission's investigation and testing process identified Generac offering for sale through various retailers generators containing small battery charging systems that were not certified to the Appliance Efficiency Database (Database), not marked appropriately, and did not meet the energy efficiency standard.
To settle this matter, Generac executed a Settlement Agreement with the Energy Commission on April 27, 2018, for $62,500.00. The penalty monies are deposited into the Appliance Efficiency Enforcement Subaccount established by SB 454 of 2011 (Pavley). Generac has also agreed to a compliance plan to test and certify each model to the Database and add the proper marking before continuing to sell into California.
