Hayward Industries, Inc. (Hayward) is a Clemmons, North Carolina, based company that manufactures residential pool pumps and motor combinations (pool pumps). Hayward sold or offered for sale pool pumps in California, from January 2015 to June 2018. 

This case was the result of an investigation performed by California Energy Commission (CEC) staff. CEC's investigation process identified that Hayward was manufacturing and offering for sale pool pumps that did not meet the design standard.

To settle this matter, Hayward executed a Settlement Agreement with CEC on December 9, 2019, for $249,152.00. The penalty monies are deposited into the Appliance Efficiency Enforcement Subaccount established by SB 454 of 2011 (Pavley). Hayward has also agreed to a compliance plan to prevent illegal sales by cancelling orders to California addresses and maintaining a statement on their website and invoices of California sale restrictions.
