Home Depot U.S.A., Incorporated (Home Depot) is an Atlanta, Georgia based company that sells home improvement products. Home Depot sold or offered for sale ceiling fans, kitchen faucets, showerheads, and state-regulated light emitting diodes (SLEDs) in California, from November 2018 to November 2022.

This case was the result of an investigation performed by California Energy Commission (CEC) staff. CEC’s investigation and testing process identified that Home Depot was selling or offering for sale Hampton Bay and Home Decorators Collection brand ceiling fans and Glacier Bay brand kitchen faucets and showerheads that were incorrectly certified to the Modernized Appliance Efficiency Database System (MAEDbS). Home Depot was also selling or offering for sale Commercial Electric brand SLEDs that did not meet the efficiency standard and were not certified to MAEDbS.

To settle this matter, Home Depot executed a Settlement Agreement with CEC on October 6, 2023, for $300,000.00. The penalty monies are deposited into the Appliance Efficiency Enforcement Subaccount established by SB 454 of 2011 (Pavley). Home Depot has also agreed to a compliance plan to discontinue sales of non-compliant models and test and certify all compliant models to MAEDbS before continuing to sell in California.
