Kohler Co. (Kohler) is a Kohler, Wisconsin, based company that manufactures plumbing fixtures. Kohler sold or offered for sale plumbing fixtures in California, from January 2018 to August 2020.

This case was the result of an industry complaint. The California Energy Commission's (CEC) investigation and testing process identified that Kohler was manufacturing and offering for sale water closets that did not meet the efficiency standard.

To settle this matter, Kohler executed a Settlement Agreement with CEC on January 6, 2021, for $12,826.00. The penalty monies are deposited into the Appliance Efficiency Enforcement Subaccount established by SB 454 of 2011 (Pavley). Kohler has also agreed to a compliance plan to prevent shipment of non-compliant models into California
