Pacific Gas and Electric Company (PG&E) and the California Energy Commission (Energy Commission) executed a settlement agreement (agreement) on August 3, 2018, to settle alleged violations of the conditions specified in the Energy Commission's Final Decision certifying the Gateway Generating Station (GGS) power project. Under the agreement, PG&E agreed to pay the sum of $50,000.00 to settle the alleged violations. PG&E also agreed to new conditions of certification for the GGS. These new conditions set opacity limits for air emissions from the GGS, require visible emissions evaluations, prior notification to Energy Commission and air quality officials of restarts after maintenance activities and require that the GGS will be made available for air quality inspections. In addition, the requirement that the GGS notify the Energy Commission of any relevant complaints or claims from members of the public has been clarified.
