RGM Distribution, Inc. (RGM) is a Brooklyn, New York, based company that manufactures plumbing fittings and plumbing fixtures. RGM sold or offered for sale plumbing fittings and plumbing fixtures in California, from July 2016 to July 2019. 

This case was the result of an investigation performed by California Energy Commission (CEC) staff. CEC's investigation and testing process identified that RGM was manufacturing and offering for sale plumbing fittings and plumbing fixtures that did not meet the efficiency standard, failed the marking requirement, and were not certified to the Modernized Appliance Efficiency Database System (MAEDbS).

To settle this matter, RGM executed a Settlement Agreement with CEC on December 30, 2019, for $81,667.00. The penalty monies are deposited into the Appliance Efficiency Enforcement Subaccount established by SB 454 of 2011 (Pavley). RGM has also agreed to a compliance plan add the appropriate marking, test and certify all models to MAEDbS, and RGM will not provide instructions directing the user to an alternative water-use setting that would exceed the efficiency standard before continuing to sell in California.
