Black and Decker, Inc is a Towson, Maryland, based company who manufactures robotic vacuums containing a small battery charger system. Black and Decker sold or offered for sale robotic vacuums in California, during the time period of November 2016 to December 2017.

This case was a result of a market survey performed by California Energy Commission (Energy Commission) staff. The Energy Commission's investigation and testing process identified Black and Decker manufacturing and offering for sale these robotic vacuums that failed the energy efficiency standard.

To settle this matter, Black and Decker executed a Settlement Agreement with the Energy Commission on September 18, 2018, for $19,600.00. The penalty monies are deposited into the Appliance Efficiency Enforcement Subaccount established by SB 454 of 2011 (Pavley). Black and Decker has also agreed to a compliance plan to remove all noncompliant units from the California market, discontinue sales of the noncompliant model, and to ensure all future models are tested, marked, and certified in accordance with the energy efficiency regulations before selling into California.
