Swagway LLC (Swagway) is a South Bend, Indiana, based company that manufactures personal e-mobility devices which contain a small battery charger system (SBCS). From June 2015 to January 2017, Swagway sold or offered for sale personal e-mobility devices which contain non-compliant SBCS in California primarily through various retailers.

The California Energy Commission (Commission) staff tested one of these personal e-mobility devices at the California State University, Sacramento - College of Engineering Energy Efficiency Laboratory and found them to be in violation of the Appliance Efficiency Regulations governing SBCS. These SBCS did not meet the energy efficiency standards, were not labeled correctly, and were not certified to the Appliance Efficiency Database (Database).

To settle this matter, Swagway executed a settlement agreement (agreement) with the Commission on October 12, 2017, for $120,705.00. Swagway has also desgined their SBCS to comply with the energy efficiency standard, tested and certified each model to the Database, and added the required labeling to the product. This investigation started as a result of an internal tip from Energy Commission staff. The penalty monies are deposited into the Appliance Enforcement Subaccount established by SB 454 of 2011(Pavley).
