Waterway Plastics, Inc. (Waterway) is an Oxnard, California, based company that manufactures residential pool pump and motor combinations (pool pumps) and pool motors. Waterway sold or offered for sale pool pumps and pool motors in California, from October 2014 to October 2019.

This case was the result of an investigation performed by California Energy Commission (CEC) staff. CEC's investigation process identified that Waterway was manufacturing and offering for sale pool pumps and pool motors that did not meet the design standard and were not certified to the Modernized Appliance Efficiency Database System (MAEDbS).

To settle this matter, Waterway executed a Settlement Agreement with CEC on May 7, 2020, for $80,000.00. The penalty monies are deposited into the Appliance Efficiency Enforcement Subaccount established by SB 454 of 2011 (Pavley). Waterway has also agreed to a compliance plan to certify all models to MAEDbS before continuing to sell in California, and to inform customers of the restriction on single speed pool pumps and pool motors by updating product packaging and maintaining restriction statements on the company webpage and invoices.
