Whirlpool Corporation (Whirlpool) is a Benton Harbor, Michigan, based company that manufactures residential exhaust fans (range hoods). Whirlpool sold or offered for sale range hoods in California, during the time period of January 1, 2014 to February 8, 2017.

This case was a result of an industry complaint. The Energy Commission's investigation process identified Whirlpool manufacturing and offering for sale range hoods not certified to the Appliance Efficiency Database (Database).

To settle this matter, Whirlpool executed a Settlement Agreement with the Energy Commission on March 23, 2018, for $160,000.00. The penalty monies are deposited into the Appliance Enforcement Subaccount established by SB 454 of 2011(Pavley). Whirlpool has also agreed to a compliance plan to test and certify each basic model to the Database before continuing to sell into California.
