California Energy Commission Adoption Hearing: Rulemaking to Amend Regulations Governing the Power Source Disclosure Program

Background

On May 17, 2024, the California Energy Commission (CEC) published a Notice of Proposed Action (NOPA) to amend and reorganize Sections 1391, 1391.1, 1392, 1393, 1393.1, 1394, 1394.1, and 1394.2 of Chapter 3, Article 5 of Title 20 in the California Code of Regulations related to the Power Source Disclosure (PSD) program. Based on comments received during the first 45-day public comment period, the CEC postponed the hearing date to consider adoption of the proposed amendments originally scheduled for August 14, 2024. On October 4, 2024, the CEC issued a Notice of Availability and Opportunity to Comment (45-Day Notice) proposing additional changes to the initial express terms and initiating a second 45-day public comment period.

Based on further comments received, the CEC issued a Notice of Availability and Opportunity to Comment (15-Day Notice) on December 9, 2024, proposing further changes to the proposed express terms and initiating an additional 15-day public comment period. The comment period closed on January 3, 2025. After review of the comments received, the CEC has scheduled the public hearing to consider adoption of the proposed amendments to the PSD program regulations to February 12, 2025.

Public Hearing

Please take notice that the CEC will hold a public hearing on the proposed amendments to the PSD regulations at the CEC Business Meeting on the date and time listed below. The express terms of the proposed amendments to be considered by the CEC are the same as those included in the 15-Day Notice published on December 9, 2024, and posted to Docket No. 21-OIR-01 at TN 260567 (Docket 21-OIR-01).

Interested persons, or their authorized representative, may present statements, arguments, or contentions relevant to the proposed regulations at the public hearing. Comments at the public hearing may be limited to two minutes or less. The record for this proceeding will be closed at the end of the hearing.
